Tyson was detained in July 1991 for the hotel room rape of Desiree Washington, then 18 years old, in Indianapolis. The Marion County superior court heard Tyson’s rape case from January 26 to February 10, 1992.
The testimony of Tyson’s chauffeur, who corroborated Desiree Washington’s amazement following the incident, provided some support for Washington’s account.
The doctor who evaluated Washington in the emergency department more than 24 hours after the assault and concluded that Washington’s physical condition was compatible with rape provided more testimony.
Tyson asserted during direct questioning by lead defense attorney Vincent J. Fuller that all of the events had occurred with Washington’s full consent and that he had not forced himself onto her.
Tyson refuted accusations that he had mislead Washington during his cross-examination by chief prosecutor Gregory Garrison and argued that she wanted to have sex with him. On February 10, 1992, Tyson was found guilty of the rape accusation following a nearly 10-hour jury deliberation.
As Tyson’s attorney, Alan Dershowitz, filed an appeal, arguing that the exclusion by the court of evidence regarding the victim’s prior sexual behavior (commonly referred to as the Rape Shield Law), the exclusion of three potential witnesses for the defense, and the absence of a jury instruction on an honest and reasonable mistake of fact were all errors of law.
By a vote of 2-1, the Indiana Court of Appeals rejected Tyson’s appeal. Due to a 2-2 split in its review, the Indiana Supreme Court decided to uphold the decision of the lower court. The Indiana Supreme Court’s Chief Justice withdrew from the vote, which resulted in a tie vote.
At a Yale Law School reunion, the Chief Justice’s wife and Dershowitz got into a furious dispute about the case, the Chief Justice later admitted.

Tyson received a six-year prison term plus four years of probation on March 26, 1992. In April 1992, he was transferred to the Indiana Youth Center, which is now the Plainfield Correctional Facility. He was freed in March 1995, having completed less than three years of his sentence.
It has been commonly stated that Tyson converted to Islam when he was incarcerated and took the Muslim name Malik Abdul Aziz; other versions have Malik Shabazz.
