Lawsuit Filed Against Illinois Gun Ban!

A new legal challenge to the state’s ban on semi-automatic weapons was submitted to an Illinois court on Monday. Thomas DeVore, an attorney who helped 866 plaintiffs obtained a temporary restraining order last week, has now brought a new action on behalf of 1,690 additional gun owners, contesting the ban’s validity. The complaint was filed in White County, where 62 plaintiffs are gun shops.

The ban, which forbade the sale of 170 guns and took effect on January 1st, 2023, has been challenged in four different instances. The new law mandates that semi-automatic firearm owners register their weapons with the Illinois State Police by January 1st, 2024.

The Illinois State Rifle Association and several gun shops across the state have filed a federal lawsuit alleging that the statute is unconstitutional. Several county sheriffs, including those from Winnebago, Ogle, Stephenson, Lee, DeKalb, and Boone, have openly stated that they will not enforce the prohibition because doing so would violate their oath of office.

Attorney General Kwame Raoul and Governor J.B. Pritzker have threatened to fire police officers who do not uphold the state’s ban. A restraining order is in place while a lawsuit challenging the validity of the SAFE-T Act in Illinois, which would do away with cash bail in the state.
